PS cares about your privacy. Therefore, we always strive to protect your personal data in the best possible way and to comply with all applicable laws and regulations for the protection of personal data. In this policy, we want to inform you about how PS collects and processes your personal data.

This policy applies to all personal data collected by PS about you as seller, buyer or bidder of an object. The policy also applies if you have a user account at psauktion.com (the ”Website”) as well as if you represents a seller, a buyer or a bidder, for example when the seller, buyer or bidder is a company and you are acting as the company’s contact person.

The provisions regarding seller, buyer or bidder in this policy also apply, where appropriate, if you are representing a seller, buyer or bidder.

What personal data do we process?

The personal data that we process is the data that you have provided us with or that we collect from you when you visit the Website or from a third party.

Personal data that you have provided to us: When you want to sell an objects through us or if you want to place a bid and/or make a purchase through us you provide certain information about yourself to us. This is also the case when you register a user account with us, sign up for the newsletter or send an inquiry to us via the Website. You may also provide information to us for other reasons. The information that you submit can be, for instance, your name, your contact and address information, your personal identity number, information regarding your economic situation and your card number.

Personal data that we have collected from you or a third party: In addition to the data you have provided to us we will also process data regarding your purchase and your bid and purchase history or sales history. When you visit the Website we will also automatically collect personal data through the Website, for example information about your IP address and which objects you have viewed and placed a bid on. If you are representing a company, we may also process data about you that we, for marketing purposes or to improve your customer experience with us, have bought or been given access to from public registers and databases.

For what purposes do we process your personal data?

All collection and processing of personal data are for the purpose to administrate and fulfill our obligations to you, improve our offers and services and to comply with all applicable laws, regulations and decisions made by authorities.

We will process your personal data in order to administrate the sale of your object if you are a seller or manage your bids, subscriptions, your purchases on the Website and your user account if you are a buyer or bidder. We may also use your personal data to send direct marketing to you, conduct surveys and compile statistics. Please see below for further information.

Administration of your sales and/or purchases on the Website

We process your name, e-mail address, delivery address, home address, bidding information and phone number to be able to administrate your user account, the bids that you place, your purchase and to fulfill our obligations to you as a seller or buyer. If you want to finance your purchase using PS Finance, or if we are otherwise required by applicable law to do so, we may also process data regarding your personal identity number and information about your financial situation to be able to do a credit check and establish your identity in connection with this. The legal basis for our processing is that it is necessary for us to fulfill the contract concerning your sale or purchase of an object. You need to have a user account with us in order to place a bid and buy objects on the Website. If the data is not provided to us, we are unable to sell an object for you or carry out your purchase on the Website or otherwise fulfill the obligations we have towards you. If we do not process your personal identification number, and data about your financial situation, we cannot do a credit check and therefore will not be able to grant you credit.

Administration of your user account

For you, who have registered a user account, we process, in addition to the personal data mentioned above, also your personal identification number, bidding and purchase history and IP address. The personal data is processed in order for us to administrate your user account and to facilitate you as a user on the Website. Your bidding and purchase history is also processed in order for you to easily get an overview of the bids you have placed and the purchases you have made. We process your IP address to be able to derive a bid to you and in this way ensure that the right person has won the bidding of an object. The legal basis for our processing is your consent that you provided in connection with registering the user account with us.

Marketing purposes etc.

We want you to continue to sell or buy objects through us, and for you to benefit from our special offers and receive information about us we will also, for a limited period of time after you have sold or bought something through us, process your e-mail address and mobile phone number to send our newsletter and other dispatches to you by e-mail, mail and SMS. The legal basis for our processing of these personal data for the purpose of sending newsletters is our legitimate interest to communicate with you as a customer for marketing purposes.

If you have given your consent to this, e.g. in connection with the registration of your account your personal data, your e-mail address, home address and mobile phone number may also be used for direct marketing, newsletter, customer surveys and/or for statistical purposes and can be used for dispatches by mail, e-mail and SMS to you until you unregister your account or withdraw your consent. The legal basis for our processing is your consent.

Who can gain access to your personal data?

As a starting point, your data will only be processed by PS and relevant companies in the PS group. We may also share your information with our selected partners and suppliers in accordance with below.

In order for your goods to be delivered to you, we will share your contact information with the transport company for the transportation of your order.

  • For payment or credit check, we may share information about your card number or social security number and information about your financial situation to the payment processors and credit companies.

  • For marketing purposes we may share your contact information to advertising agencies and printing firms for e.g., printing and distribution of dispatch.

  • Our internal and external IT suppliers and any other suppliers we hire may get access to all the personal data we handle about you, but only to the extent necessary in order to fulfill their obligations in relation to PS.

  • Our agents may have access to all the personal data we process about you, but only to the extent necessary in order to fulfill their commitments as an agent of PS.
     
  • Our supplier whose items you as a bidder have won, may have access to invoice documentation.

How long do we process your personal data?

Personal data that we process in order to administrate sale, bidding or purchase of an object or to fulfill our obligations to you under the agreement will not be stored for longer than is necessary for us to administrate the sale, bidding or purchase or to otherwise fulfill our agreement.

For the purpose of bookkeeping, we store, in accordance with applicable accounting legislation, information about our agreement with you for seven years.

In accordance with applicable legislation, we are entitled to store your contact information for direct marketing purposes over a period of time after your purchase or our agreement has expired. Depending on what the agreement regards, the length of this time differs. PS may therefore store your contact information in order to send direct marketing to you during the time we have the right to do so in accordance with current data protection legislation, marketing legislation and practice.

If you have specifically given your consent to receiving direct marketing, we will store personal data consisting of your e-mail, address and mobile phone number until you unsubscribe or ask us to stop contacting you.

For you who have registered an account with us, we will process all your personal data until you unregister your account with us or ask us to delete certain data. However, we always erase your account if you have been inactive for two years. Purchase history is sorted out in any event at the latest after two years after the purchase.

Your personal data may be stored longer than the above, to the extent we are required to do so by law, regulation or decisions made by authorities.

Your rights

You are entitled to request information about the personal information we have saved about you at any time. Your request must be in writing and in its own right signed and include name and social security number. We need this to ensure that we provide the information to the right person.

Send your request for registry information, information or correction of incorrect data to: gdpr@psauction.com. The information will be sent to your registered home address.

If your information is incorrect, incomplete or irrelevant, you may wish to have them corrected. We can not delete data that constitute public documents or when there is a statutory requirement for storage, such as accounting rules. Nor can we delete data when there are legitimate reasons why the data must be saved, such as unpaid debts.

You may, under certain circumstances, have access to your personal data in a widely used, machine-readable format (data portability). This right, however, applies only to information you have provided to us and if they are processed to fulfill an agreement with you or with the consent of you.

You are entitled to withdraw all or part of a given consent for processing personal data at any time. However, the revocation of your consent will not affect our processing of your personal data before the revocation took place. You are also entitled to object to the processing of your personal data for direct marketing at any time.

In accordance with current data protection laws, you have the right to access information about what personal data we are processing about you and the right to request a correction of your personal information.

Transmission to third countries

PS Auction only transfers personal data to countries outside the EU / EEA if the country has an adequate level of protection under the EU or EU Commission, or if this is specifically stated when you provide your personal information to us.

Cookies

PS Auction websites use cookies to help you get a personalized internet experience and session-cookies to manage your visit. A cookie is a text file that a web server places on your hard drive. Cookies can not be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie file to you. One of the main purposes of cookies is to tell the Web server that you have returned to a specific website, so you can get a personalized experience when you visit the website again.

PS Auction uses YouTube API Service to embedd videos on the website. Visitors who watch these videos are bound to Youtube Terms of services and agrees that their personal data is treated with accordance of Google Privacy Policy.
